2. Terms and Conditions 

Article 1 Definitions

1.1 "Embassy" refers to the Embassy of the people's Republic of China.

1.2 "Consulate General" means the Consulate General of the people's Republic of China.

1.3 "Other Consular Institutions" indicates the consulates, consular offices and related Institutions of the people's Republic of China.

1.4 "Embassy and consulate" indicates the Embassy and/or Consulate General and other Consular Institutions.

1.5 The "Chinese Visa Application Service Centre", hereinafter referred to as "Application Centre" is the service company that operates the visa application service according to the criteria established by the Embassy and the Consulate.

1.6 "customer" means the applicant or the delegate, that makes this request for visa to enter the territory of the people's Republic of China. The applicant may be a natural person, a travel agency or an agency of consular practices.

1.7 "customer data" means any data or information that the customer provides the Application Centre under hard copy, electronic or other forms considered appropriate for the Application Centre can provide the necessary services.

1.8 "personal information" means all information provided by the applicant, contained in documents of visa application, which include, but are not limited to: name, gender, date of birth, place of birth, marital status, citizenship, data Passport, phone number, information concerning the State of health and criminal records, home address, work place, family member information, video recordings, phone records, e-mails and other personal information. 

1.9 "website" means the website www.visaforchina.org that provides on-line services such as: customer communications, visa application form, information on the processing of data, requests for appointments and status check visa application.

1.10 "Basic Services" means the services of visa application that the Application Centre offers the customer.

1.11 "additional services" means the services offered by the Application Centre other than the services according to the customer.

1.12 "visa costs" means consular fees due at the Embassy and at the Consulate and collected by the Application Centre on their behalf. The amount of these expenses isestablished by the Embassy and the Consulate and includes but is not limited to the request under normal expenditure, expenditure on request with extra charges request under urgent procedure-urgent. 

1.13 "service fees" mean the charges payable to the Application Centre for the provision of basic Services. The charges for additional services are not included in the service charge.

1.14 "Receipt for collection" means the receipt issued by the Application Service to the customer as a result of the visa application. This receipt is the only document certifying the payment of consular fees and service due, and the only document to collect the passport and visa. 

Article 2 Basic Services Offered by the Application Centre

2.1 Basic services are to welcome customers and classify the documentation of visa application under rules established by the Embassy and the Consulate of the people's Republic of China.

2.2 Provide the client with brokerage services, including the inclusion of background information in electronic format, passport, visa and shipping customer data between the Embassy, the Consulate and the Application Centre.

Article 3 Use of the Visa Application Services

3.1 The customer declares to be aware that the Application Centre is not in any way involved in the evaluation process of the visa and its assent or dissent. 3.4 The client must carefully check all information upon receipt for collection delivered from Application Centre and make sure there are no errors. 3.7 Unless otherwise advised by Application Centre, the client must collect the passport with visa before it expires. If the Passport is not withdrawn before the expiry of the visa, the Visa Application Centre has no obligation with respect to the custody of the Passport. Once upon the expiry date, i.e. after 365 days of the issuance or refusal of visas from the Embassy and the Consulate, the Application Centre has the right to deliver their travel documents to the Embassy and Consulate, which will return them to the competent authorities of the country that issued the Passport. 

Article 4 Use and Protection of Personal Information

4.1 The customer declares to accept that the personal data transmitted to the Application Centre via internet, personally or through a delegate, can be collected, transmitted, stored, processed and used by the Application Centre in accordance with the listed in these general conditions and in respect of data processing according to Regulation (EU) 2016/679.

4.2 To process the customer's visa application, the Application Centre shall collect personal data by request documents delivered and insert them into the computer system.

Article 5 Responsibility
 

5.1 If a passport is lost or damaged while in custody at the Application Centre, this will cover expenditure strictly necessary for the applicant to issue, a standard procedure, a new passport, to replace the lost or damaged by the Passport Office has jurisdiction. These expenses will be reimbursed by the Application Centre upon presentation of the receipt issued by the competent authority. 5.4 Within the extent allowed by law, the Application Centre disclaims all conditions and warranties, whether express or implied, for the service of visa application not listed in these terms and conditions. Where the law does not provide for such an exclusion of liability and implies certain terms, conditions and warranties between terms ("implied terms"), the responsibility of the Application Centre for the infraction of these implied terms is limited to one or more of the following, at the discretion of the Application Centre:
a) new visa application service delivery;
b) costs for the new visa application service delivery;
c) received fees, payable by the customer to the competent governmental departmentor institution (upon presentation of proof of payment). 

5.5 The customer is aware and agrees that under no circumstances the Application Centre is not responsible for any complaints by the customer or by third parties relating to indirect, incidental, special or consequential damages of any kind, or any loss of opportunity, business, credibility, business interruption, regardless of whether such losses are related to the visa application, service or are caused by errors, omissions or negligence on the part of managers, operators, employees and Application Centre representatives.

5.6 All the above terms and conditions shall be subject to the laws of the country in which each Application Centre is located. Any litigation relating to the visa service that were to occur, will be submitted to the judgment of the Court of the country where the Application Centre is located. 

Article 6 Other Terms and Conditions

6.1 The Application Centre may, without notice, modify, delete or withdraw part or all of the terms and conditions. In the event that the customer does not accept changes to the terms and conditions, may reject the offered services from Application Centre.
